The goal of this contract is to establish the general conditions of use and purchase of products and services by the client in Portugal Nosso’s platform. 

The purchase of any products in this website is subjected to the conditions written below.

Please read these terms and conditions of use carefully, as these regulate your access to this website, as well as the way you use it. By accessing or using this website, you accept these terms and conditions fully and with no reservations, as well as any indication, restriction or norm that may be implemented in specific sections or services in this website.

In the case of wines, very important: regardless of the year / harvest indicated on the page of each wine product, we sell the harvest that the producer has available at any given time and on trade. The indication of the harvest is merely indicative. Therefore, if the customer wants a wine, not by brand/type, but by a specific vintage, he must contact us before making the purchase. By confirming the purchase and confirming our purchase conditions, you will not be entitled to returns.

If you intend to return your purchase, you must immediately send an email where you must present a reason for the return. After analysis by our team, you will be informed whether or not the reason given meets the requirements for the return. In case it is accepted, the customer can send the cargo to our facilities or check with our online support team about the possibility of us collecting it at the address to be indicated. Note that the return cost is always borne by the customer. Considering that these are niche, sensitive, and/or perishable products, you will have a period of 1 day after receiving the product to do so (that is, contact us and explain the situation), and only merchandise that is received in the proper conditions (including the original packaging). Shipping costs are the responsibility of the customer, as mentioned. The case of Christmas hampers is a different matter. As a rule, customers want to offer something for Christmas dinner or New Year’s Eve. In any case, we do not commit or guarantee the delivery of baskets whose orders have been placed after the 9th of December. On the other hand, even if there are considerable delays in the delivery of the basket for reasons of a varied nature, cancellation of the order or requests for a refund of the value are not accepted. We view baskets as a gift, which is a strong factor in our performance and competitive advantage. And we guarantee delivery at the address (indicated at the time of purchase), despite any delays that occur or have occurred.

In short, in any case, where the requirements for canceling the order and returning it are met, Portugal Nosso will only refund the amount corresponding to the goods. Returns arising from a defect in the product are excluded, in which case Portugal Nosso undertakes to exchange the product immediately for another product that is the same or has identical characteristics. To do this, contact us by phone at +351 926 140 973, by Chat, or by E-mail (info@portugalnosso.com) and inform the order number and the code of the product to be exchanged, both described in the invoice, next to the name of the commodity and the reason for the request.

The present general contractual conditions, or any other that may be implemented, regulate the relations between the brand Portugal Nosso, the entrepreneur Pedro Silva Baptista, based in Praceta Francisco Borges, 99, 5.8, 4200-310, Porto, Portugal, NIF 271923245, and the third parties that use this webpage, from here on designated as clients. We designate as product all the merchandise included in the purchase contract.

By using the services provided by this website, the client recognizes and accepts that all the terms and conditions established in these general conditions will be applicable.

Alcoholic beverages can only be purchased by someone that, in his or her country of residence, is within legal age for alcohol consumption.

All prices are indicated in € (euro) and include, according to Portuguese legislation, VAT (6%, 13% and 23%). The purchase will always be done in € (euro). The prices shown can be altered without prior notice and are always subject to the existing stock. The orders will be processed by order of arrival and, in case of any temporary or even definitive stock rupture, the client will be duly informed and we will suggest an alternative with other products of similar characteristics.

If an order cannot be done, partially or totally, the client will be immediately notified by our support service, so we can find the most suitable solution. All orders will only be processed after receiving payment. The order alone is not considered a reservation of the product.

Portugal Nosso holds the responsibility of preserving the confidentiality of all data and information provided by the client in the purchase process. The website’s security is audited on a daily basis.

We have the SSL security certificate, which means that all the information sent and received between the server and the website’s user is encrypted.

Thus, the client recognizes and consents that all the copyright, trademark and further intellectual property rights over material or content provided as part of the webpage are, at all times, ours or whoever authorized its use. The client can only use such material in a way that is expressly authorized by us or whoever authorized its use. This does not impede the client from using this webpage, whenever needed, to copy information concerning the order or data from the present contract.
However, with the exception of the case explained above, the user/client is not authorized to use, in any form or under any pretext, the trademarks, contents and services provided by the website, as Portugal Nosso may take legal action in case of undue use or reproduction.

This service intends to provide our visitors with relevant information within the areas of interest that Portugal Nosso focuses on. The orders will be delivered by specialized companies. As a rule, the delivery may occur within 48 to more than 96 hours, to destinations in Europe, or within a few weeks for countries outside Europe (always after shipping). There might be some exceptions out of our control, such as natural catastrophes or other factors.

The delivery date is always given during the purchase process, counted in working days. The orders will be made from Monday to Friday, from 8 a.m. to 6 p.m.
Exceptionally, some deliveries might occur on Saturdays, Sundays and holidays.

Despite the indication of the year on the product page, the harvest that the customer receives is the last and / or the most recent made / available by the producer, unless there is stock available.

Confirm the information on the article label. Due to possible changes in packaging and / or labels, you should always consider the information that accompanies the product you receive.

The client will have at his or her disposal the universal payment system, PayPal, Payshop, credit and debit cards (Visa, Mastercard, Maestro, American Express, etc.), MIB Way, ATM and bank transfer.

Orders may be cancelled without any cost, as long as it’s done before the product is shipped. After shipping, if a cancelation request is made, it will be dealt as devolution.

If you would like to return your purchase, you must immediately send an e-mail, explaining the reason for the devolution.

After sending the e-mail, you will be informed on how to return the product. You have 1 day upon reception to return the product and we will only accept products in proper conditions (including the original packaging). The shipping costs will be charged to the client.

Portugal Nosso will only restitute the amount corresponding to the merchandise, except devolutions derived from any product defect. In that case, Portugal Nosso commits to replace the product immediately (for the same item or other of identical characteristics). For that, you must contact us via telephone: +351 926 140 973, by chat or e-mail (info@portugalnosso.com) to inform us of the order’s serial number and the product’s code, both included in the bill of sale, next to the name of the merchandise and the reason for devolution.

Portugal Nosso does not take responsibility for orders made for countries where the law does not allow the entrance of natural products or alcoholic beverages. The potential arrest of the merchandise is the client’s responsibility. In case of devolution, Portugal Nosso will restitute only the value of the merchandise, after deduction of financial costs and costs associated with transportation. Due to factors unrelated to Portugal Nosso, some products’ orders may be subjected to custom fees and taxes when they enter their country of destination. The import fees and taxes are always charged to the buyer/importer. If there are any additional costs in customs, import rights or applicable taxes, these will be charged to the buyer upon reception of the delivery. These costs are impossible to predict, since they are the responsibility of each country’s customs. The buyer/client is also responsible for knowing the restrictions and respective fees of his country of residence.

Portugal Nosso does not take responsibility for contractual changes and the damage resulting from those changes, namely the ones resulting from situations of force majeure, such as communication impediments, natural catastrophes, the blockade of means of transportation, strikes, as well as legislative or regulatory changes that may render impossible, totally or partially, to provide our services as described in our general conditions and terms.

Portugal Nosso reserves the right to annul orders that have incorrect prices due to electronic error, returning the value paid by the customer immediately. Portugal Nosso is not responsible for costs that may derive from interference, omission, interruptions, computer viruses, malfunctioning or disconnection of the customer’s software and hardware, or any blockage and overloads while using the internet, or interference in your personal data that is not of Portugal Nosso’s responsibility.

The customer is responsible for the correct use of the platform and its services, guaranteeing good commercial practices. Resale of the products sold here is prohibited (especially in sites that use Marketplace). The resale of the services we provide is also prohibited.

Portugal Nosso reserves the right to limit or refuse requests or orders we may understand to be negotiators, resellers or distributors. We can also limit or cancel the amount of products acquired by each customer or by order. Besides, the customer is responsible for following the norms described in this agreement and for the protection of the access data of his or her account (login and password).

Portugal Nosso reserves the right to block access to anyone who uses the website in an abusive or improper way or that, by any other means, may constitute an actual or potential threat to the normality of the website or to any other third parties involved.

In case one or more of the provisions of these General Contractual Conditions is considered null, all the other provisions remain valid.

All litigation derived from the interpretation or execution of the present agreement will be settled by the Judicial Court of Braga, exclusively, renouncing any other courts.
